N orthern A rizona U niversity is no exception in this regard and recognizes that m em bers o f o u r M ountain C am pus m ake up a unique com m unity o f students, faculty and staff. A s in any com m unity, there ex ists a set o f expectations fo r each mem ber. The sectio n s that follow relate to these ex pectations and m ake every effort to outline a philosophy o f expected student conduct (see th e two sections en titled “C ode o f C onduct). T h e section follow ing th e “C ode o f C onduct” entitled ‘"Student D isciplinary Procedures'” provides specific inform ation a s to how stu d en t conduct issues are dealt w ith procedu rally here at Northern A rizona U niversity P lease notice that there are tw o versions o f the “C ode o f Conduct'* in this particular A ppendix (one is id en tified as “O riginal D ocum ent” and o n e is identified a s “ A pproved by B oard 6/1/90” ). T h e three state universities in Arizona (N orthern A rizona U niversity. A rizo n a S tate U niversity an d the U n iversity o f A rizona) have been in the process o f d eveloping the “ Rules fo r the M aintenance o f Public Order'*, during th e past few years in conjunction with the A rizo n a S tate B oard o f R egents. T h e “R ules for the Mai ntenance o f Public O d e r ’* w ere not com plete w h en this handbook went to print during the sum m er o f 1995 Until revisions are finalized and adopted by th e A rizona State B oard o f R egents, it was im perative to include both “C odes” in this y ear’s Student Handbook a s they would be incom plete otherwise. N otification w ill be provided to students and updates w ill o ccu r when final revisions are ready fo r im plem entation. CODE OF CONDUCT ORIGINAL DOCUMENT 5*301 Preamble A. Jurisdiction and Authority 1. The A rizona Board o f R egents is ch arged by law to ex ercise control and supervision o f the three stale universities, their properties and activ ities, an d i s aul tiorized to enact ordinances for the g overnm ent o f the institutions u n d er its jurisdiction. The B oard is further required by law to adopt rules and regulations for the m aintenance o f public order upon alt university property under its jurisdiction The B oard has prom ulgated this C ode o f C onduct in o rd e r to meet its responsibilities u n d er Arizona law. 2. T h e adm inistration at each o f the state universities is to assist th e Board in the enforcem ent o f th e rules and regulations set forth u n d er th is Code, but the au th o rity o f the adm inistration is subject to the ultim ate authority of the B oard B. Philosophy 1. T h e ed u c atio n al p ro cess is id eally c o n ducted in an environm ent that encourages reasoned discourse, intellectual honesty, openness to constructive change and respect for the rights o f all in d ividuals. T h is C ode of C onduct is designed fo r the p rom otion and protection o f such an environm ent at each o f th e state uni versifies. 2. A cceptance o f m em bership in the university co m m u n ity am ounts to neither a su rren d er of those individual rights accorded to all citizen s of this country n o r a means fo r escapingthe atten d a n t. fu n d am en tal resp o n sib ilities o f th at citizen sh ip . M em bership in the university com m unity brings rig h ts a s w ell as responsibilities This C ode o f C o n duct sh all be im plem ented by the adoption o f sets o f procedural ru les appropriate for th e various segm ents o f the university com m unity, which shall provide fo r the full protection o f individual rights and freedom s. C. Punx»e and Intent 1 . The prim ary purpose for th e enactm ent of this C ode o f C o n d u ct is to set forth in a clear and concise m an n er the rules and regulations o f con d uct ex p ected o f those who jo in the uni versity co m m unity. or w ho axe present on th e university cam pus or p articipating in any university sponsored a c - tivity. 2. It is intended that the sanctions listed in this C ode be im p o sed and enforced fo r the protection o f the university com m unity and for th e m aintenance o f o rd e r an d stability, both w ith respect to activities o ccu rrin g o n the university c a m p u sa n d w ith regard to all university-sponsored activities. D. Limitations Uoon Code Coverooe 1. T he adoption o f this C ode o f C onduct does not prohibit any university or the A rizo n a B oard of Regents from adopting o r m aintaining additional conditions, rules, regulations an d procedures not in conflict w ith this C ode and w h ich address m atters not co v e red by th is Code. C harges brought pursu - ant to this C ode m ay be co m b in ed w ith charges b rought pursuant to other conditions, rules o r re g u lations, p ro v id ed adm inistrative p rocedures for e n fo rcem e n t o f th e C ode are used to re so lv e the charges. 2. A m ong the m atters specifically excluded from coverage u n d er this C ode are th e following: a. Rules and regulations w h ich have been o r w ill be adopted by each university w h ich pertain to th e control o f vehicles on university property. b. R egulations and procedures relating to student academ ic perform ance. o th eT than academ ic d ishonesty m atters, e.g., gTade ap p eal procedures. c. S tudent hou sin g re g u la tio n s and contracts w here sanctions are not im posed that extend beyond the student housing setting. 3. The C ode is not intended to interfere with the internal corporate affairs o f organizations such as the A ssociated Students, sororities, fraternities, honor societies, and sim ilar organizations, but such organizations are otherw ise su b ject to Lhis Code. E. Violations ot Law and Code Regulations M em bers o f th e university com m unity m ay be a c countable to both civil authorities (city, stale nr federal ) and to th e university fo r acts w hich constitute violations o f law and o f this C ode D isciplinary action at the university m ay proceed du rin g th e pen dency o f crim in al proceedings and w ill not b e subject to challenge o n the ground that cri rnina I charges in v o lv in g th e sam e incident have been d ism issed o r red u ced T h ere is no legal basis fo r any clam, o f double jeo p a rd y and no right to im m unity m ay be urged in any adm inistrative proceedings 5-302 (R7-4-101) Definitions In this C ode o f C onduct, unless the co n tex t otherw ise provides o r requires: _ 1. “A ggravated violation'* m eans a violation w hich resulted o r foreseeahly could h av e resulted in significant dam age topersons or property o r w hich o therw ise posed a substantial threat to th e stability and continuance o f norm al universi ty o r university-sponsored activities. 2. “ B oard” m eans the A rizona B oard o f Re gents. 3 . “C heating” m eans intentionally using or at tem pting to use unauthorized m ate n al« i nform ation or study aids in any academ ic exercise 4. “C o n tro lled su b stan ce” m ean s a drug o r substance listed in sch ed u les contained in A.R.S. Para. 36-2512 through 36-2516. 5. “D istribution” m eans sale o r exchange for personal profit. 6. “Fabrication” m eans intentional an d unauthorized falsification or invention o f any inform ation o r citation in an academ ic exercise 7. "Faculty” m eans all em ployees o f the A rizona Board o f R egents in teaching, research or service. w hose n otice o f appointm ent is as lecturer, in structor. assistant professor, associate professor, professor or otherw ise d esignated as faculty on the n o tice o f appointm ent. G raduate students w ho serve as assistants, associates or otherw ise, are academ ic appointees as w ell as graduate students but are not m em bers o f the faculty. 8. “Group” m eans a num ber o f persons who are associated w ith each o th er and w ho have not com plied w ith university requirem ents for registration as an organization. 9. “Illegal d rug” m eans any d ru g whose use. possession o r distribution is prohibited or restricted by provisions o f Title 13 o f th e Arizona Revised Statutes, and includes, w ithout lim itation, narcotic drugs, dangerous drugs, m arijuana and peyote 10. “O rganization” m eans a num ber o f persons w ho are associated with each other and w ho have com plied w ith university requirem ents fo r reg istration 11. “ Plagiarism ” m eans intentionally or know ingly representing the words or ideas o f another as o n e's ow n in any academ ic exercise. 12. “ President” m eans l he pre si dent o f the un i - versity o r a designee 13. “ R eck le ss” m ea n s c o n d u c t w h ich one should reasonably be ex pected to kn o w w ould cre ate a substantial risk o f harm lo p e rso n so r property or w hich w ould otherw ise be likely lo result in in terference w ith university o r university sponsored activities. 14. “Student” m eans any person registered o r enrolled in one or m ore classes ex cep t a faculty m em ber or full-tim e em ployee who lakes any course as a privilege o r employ ment G raduate students w ho serve as assistants, associates o r o th erw ise , and all other students em ploy ed part t ime are classi Tied as students rather than faculty or o ther university em ployee 15. U ni versi ty" m eans I he appropriate uni ver-sily involved. The U niversity o f A rizona . An zona S tate U niversity. N orthern Arizona Uni versity. and any other university governed by the A n /o ra Board o f Regents. 16. “ University cam p u s” m eans all land, buildings. facilities and other property owned, used or controlled by the university. 17. “ University com m unity” m eans university sludcnts.adininislrativc and staff personnel, mem hers o f th e faculty and all other university em ploy ees. 18 “University property" m eans all real and personal property owned by the university or ow ned by the A n /o n a Board o f R egents and used by the university and includes all such property in the possession o f o r subject lo the control o f th e university. 19 "University sp>nsored activity" means any activity on o r off cam pus which is initiated, aided, authorized o r supervised by the university 20. "W eapon” m eans any object or substance designed to inflict a w ound, cause injury, o r in capacitate. including, w ithout lim itation, all firearm s.- pellet guns, sw uchbla.de knives, knives w ith blades five or m ore inches in length, and chem icals such as “m ace’*or tear-gas, b u tex clu d in g norm ally available over-the-counter self-defense chem ical repellents 5-303 (R7-4-102) Prohibited Conduct The following m isconduct is subject to disciplinary action: 1. All form s o f student academ ic dishonesty, including cheating, fabrication, facilitating academic dishonesty and plagiarism 2. Intentionally o r recklessly causing p h y sical harm to any person on the university cam pus or at a university sponsored activity, o r intentionally or recklessly causing reasonable apprehension o f such harm . V U nauthorized use. possession o r storage o f any w eapon, explosive device or firew orks on the university cam pus or at a university sponsored activity. 4. Initiating or causing to he initiated any intentionally false report, warning o r threat o f fine, explosion o r other emergency on the university cam pus o r at a university-sponsored activity. 5. Intentionally o r reck lessly interfenng wiih normal university o r university sponsored activities, including, but not lim ited lo. studying, teaching, research, university adm inistration, or fire, police or em ergency services. 6 K nowingly violating the term s o f any d isciplinary sanction im posed for an earlier violation of this Code. 7. U nauthorized use, possession o r dislribu lion o r possession for purposes o f distribution o f any controlled substanc e or illegal drug on the u n iversity cam pus or at a university-sponsored activ ity 8. Intentionally o r recklessly m isusing o r dam aging fire safely equipm ent 9. intentionally furnishing false inform ation, including false identification, lo the u n iv ersity 10. Forgery, unauthorized alteration or unauthorized use of any university docum ent o r instrum ent o f identification. II Intentionally and substantially interfenng w i th the freedom o f e xpression o f others on the un i versity cam pus or at a university-sponsored activ ity 12.
